1. Scope and Application

This privacy policy applies to all personal information collected, held, used, or disclosed by Taine Foxcroft trading as CutCycle (referred to as "CutCycle", "we", "us", or "our") through:

CutCycle is bound by the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy describes how we comply with those obligations.

By using our App, Website, or services, you acknowledge that you have read and understood this policy. If you do not agree with this policy, please do not use our services.

2. What We Collect and Why

We collect personal information that is reasonably necessary for our business functions. We do not collect information we do not need. The table below sets out the types of information we collect, why we collect it, and the relevant Australian Privacy Principle.

How We Collect Information

We collect personal information in the following ways:

Sensitive Information

We do not collect sensitive information as defined under the Privacy Act 1988 (such as health information, racial or ethnic origin, political opinions, or biometric data). If we ever need to collect sensitive information in the future, we will obtain your explicit consent first.

Unsolicited Information

If we receive personal information that we did not request and determine that we could not have collected it under the APPs, we will destroy or de-identify that information as soon as practicable, provided it is lawful to do so (APP 4).

3. How We Use Your Information

We use your personal information for the purposes for which it was collected and for directly related purposes you would reasonably expect (APP 6). Specifically:

We will not use your personal information for direct marketing unless you have given us your express or implied consent. You can opt out of marketing communications at any time by updating your preferences in the App or contacting us through the App.

4. Who We Share It With

We do not sell, rent, or trade your personal information. We share personal information only with the third-party service providers listed below, and only to the extent necessary for them to perform their function. Each provider is contractually required to protect your data (APP 8).

If CutCycle is involved in a merger, acquisition, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you via email before your information becomes subject to a different privacy policy.

5. Storage and Security

We take the security of your personal information seriously and take reasonable steps to protect it from misuse, interference, loss, unauthorised access, modification, and disclosure (APP 11).

Operational Safeguards

No method of electronic storage or transmission is 100% secure. While we take reasonable steps to protect your personal information, we cannot guarantee absolute security. If we become aware of a data breach that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) in accordance with Part IIIC of the Privacy Act 1988 (Notifiable Data Breaches scheme).

6. Data Retention

We retain your personal information only for as long as it is needed for the purposes for which it was collected, or as required by law (APP 11.2).

When personal information is no longer needed and no legal obligation requires us to keep it, we will take reasonable steps to destroy it or permanently de-identify it.

7. Your Rights

Under the Australian Privacy Principles, you have the following rights regarding your personal information:

Right to Access (APP 12)

You can request a copy of the personal information we hold about you. We will respond to your request within 30 days. There is no charge for making a request, but we may charge a reasonable fee for providing access if the request requires significant effort to compile (we will let you know in advance).

Right to Correction (APP 13)

If you believe any personal information we hold about you is inaccurate, incomplete, out of date, irrelevant, or misleading, you can ask us to correct it. You can update most of your information directly in the App (account settings, property details, notification preferences). For anything else, contact us and we will correct it within 30 days.

Right to Deletion

You can request that we delete your personal information. We will action your request within 30 days, except where we are required to retain certain records by law (such as financial records for tax purposes). We will tell you what we can and cannot delete and why.

Right to Withdraw Consent

Where we rely on your consent to process personal information, you can withdraw that consent at any time. This includes opting out of marketing communications and push notifications. Withdrawing consent does not affect the lawfulness of any processing carried out before the withdrawal.

How to Exercise Your Rights

To make a request, contact us through the App (navigate to Settings > Support > Privacy Request) and select the type of request: Access, Correction, or Deletion.

We will verify your identity before processing any request. We may ask you to confirm details associated with your account so that we can be confident we are disclosing information to the right person.

Apple and Google App Store Rights

If you downloaded the App from the Apple App Store or Google Play Store, you may also have additional rights under those platforms' terms. You can delete your account directly from within the App at any time by navigating to Settings and selecting "Delete my account".

9. Children's Privacy

CutCycle's services are designed for property owners and managers aged 18 and over. We do not knowingly collect personal information from anyone under the age of 18.

If we discover that we have inadvertently collected personal information from a person under 18 without verified parental consent, we will take steps to delete that information as quickly as possible.

If you believe we may have collected information from a person under 18, please contact us immediately through the App.

10. Overseas Disclosure

As outlined in Section 4, some of our third-party service providers are located outside Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the recipient handles information in a manner consistent with the APPs (APP 8).

11. Changes to This Policy

We may update this privacy policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons.

Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated policy. If you do not agree with the changes, you may close your account before the changes take effect.

Making a Complaint

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, you can make a complaint through the App (Settings > Support > Privacy Complaint).

  2. We will investigate and provide a written response within 30 days.
